Divorce Mediation Services in New York

Tailored Strategy for Your Unique Situation

What Is Mediation?

Mediation is a structured, guided conversation between you and the other party, facilitated by a neutral third party called a mediator. Unlike courtroom litigation, mediation gives you control over the outcome — you and the other side work together to reach an agreement that works for your family, your finances, and your future.

At New York Family Law & Mediation, PLLC, our Forest Hills-based mediation team has over 20 years of experience helping Queens families resolve divorce, child custody, child support, and other family law matters — without the cost, delay, and stress of going to court.

How Does Divorce Mediation Work in New York?

In mediation, a neutral mediator guides both parties through the key issues that need to be resolved before a divorce can be finalized in New York. These may include:

  • Division of marital assets and debts
  • Child custody and parenting schedules
  • Child support
  • Spousal support (maintenance)
  • Who keeps the family home, car, or pets

Every session is tailored to what matters most to you and the other party. Nothing gets buried. The mediator keeps the process moving, ensures all issues are addressed, and helps both sides reach a fair, workable agreement.

Is Mediation Cheaper Than Going to Court in New York?

Yes — in most cases, significantly so. Mediation is generally far less expensive and much faster than litigation. When both parties can reach an agreement through mediation, they save on attorney fees, court costs, and the months (sometimes years) a contested divorce can take in New York courts.

Once an agreement is reached, all that remains is waiting for the court to process it. For many Queens couples, mediation means never having to set foot in a courtroom at all.

What If We've Already Agreed on Some Things?

That's very common — and it's not a problem. You don't have to start from scratch. Many couples coming to mediation in Queens have already worked out certain issues and simply need help resolving what's left.

(Note: New York courts cannot finalize a divorce until every issue is resolved.)

Bring the issues that still need resolution. We'll take everything you've already agreed on, work through the rest, and package it all into a complete settlement agreement ready for the court. For example, many parents have already figured out a parenting schedule but still need to resolve child support — we handle that every day.

Our Flexible Mediation Options in Forest Hills, Queens

At New York Family Law & Mediation, PLLC, we work with you wherever you are in the process. We offer:

  • Full mediation — We guide you through every unresolved issue from start to finish and prepare all required court documentation.
  • Partial mediation — You've resolved some issues already; we help with the rest and package it all for the court.
  • Agreement formatting — You've reached a full agreement (even with another mediator); we format it into the documents the court requires.

We can step in at any stage and get you over the finish line. Our mediator is backed by a full team of attorneys, legal professionals, and an experienced administrative team. As long as both parties are willing to cooperate, we can get you divorced.

What If I Want an Attorney Involved?

Not ready to mediate without legal support? That's completely understandable.

Attorney review and consult: Our legal team is available throughout the mediation process in a review and consulting capacity. We'll explain New York family law, walk you through the terms you're considering, or review your draft agreement at any point — outside of the actual mediation session.

Collaborative law: Prefer to have an attorney present in the room during mediation? We offer collaborative law services, where each party has their own attorney participating directly in the sessions. This approach keeps the cooperative spirit of mediation while ensuring both sides have immediate legal guidance.

Family Mediation Beyond Divorce

Our Queens mediation practice handles a wide range of family law matters, including:

  • Child custody and parenting disputes
  • Child support modifications
  • Prenuptial agreements
  • Postnuptial agreements
  • General family disputes

If your family situation doesn't involve a divorce but still needs resolution, we can help.

What Happens After Mediation Is Complete?

At the end of each session, your mediator will provide a written summary tracking the issues that have been tentatively resolved and any action items for the next session.

Once all issues are resolved, we draft a formal agreement, circulate it for review, and have it signed and notarized by all parties. This is a legally binding contract and becomes the foundation for any court orders or judgments.

A few important things to know about your mediation agreement in New York:

  • Divorce agreement — Once signed, you may never need to appear in court.
  • Family court matters — A court appearance will be required.
  • Prenuptial, postnuptial, or separation agreements — These are not filed with the court.

If you haven't worked with an attorney during the process, we strongly recommend having the agreement reviewed by one before signing.

How does virtual mediation work for Queens County divorce filings?

  • Virtual mediation works similarly to in-person meetings and is often preferred by many people for convenience (no traffic or hunting for parking). We will discuss the issues like any other mediation session.

Is a flat-fee mediator cheaper than a traditional divorce lawyer in NYC?

  • Generally, yes. The flat-fee structure includes payment for everything necessary to complete the mediation process from the time spent in sessions to the time spent drafting the mediated agreement. Mediation is meant to be an easier and cheaper alternative to a traditional attorney. Traditional attorneys will typically charge by the hour, which can quickly add up quickly, especially if working through the court.

Can I complete my entire divorce mediation virtually without seeing my spouse in person?"

  • Yes. Mediation sessions can be done entirely virtually, and you can even sign the papers withing seeing your spouse. The entire mediation process is based on how you (and your spouse) want to handle it.

Do prenuptial agreements in New York cover cryptocurrency and digital assets in 2026?

  • Prenuptial agreements can cover many issues including cryptocurrency and digital assets. Mediation agreements can also cover those items and almost anything you want to be included that doesn’t violate public policy.

Who keeps the power in a mediation vs. a judge-led divorce in Forest Hills?

  • Mediation is a process driven entirely by the parties. The mediator is only a neutral party who helps you have the conversation and get everything out in the open in order to put it all in an agreement at the end. However, the sessions are decided by you and your spouse. You decide what issues are most important and what things you want included in the agreement and then we build the mediation sessions based on your preferences.

What is the fastest way to get an uncontested divorce finalized in Queens?

  • The fastest way to get an uncontested divorce is to get the documents finalized and filed as quickly as possible. If both parties can agree to their terms, the process will be much smoother. The courts have many active cases, so the best you can do is to get your case fully filed quickly.

How do we handle virtual custody mediation if we live in different parts of New York or New Jersey?

  • With any issues, mediation can be done virtually, especially if the commute would be difficult for one or both people participating in mediation. The process is based on what you want to do and what you can do.

Is it too late to sign a postnuptial agreement if we are already having marital issues?

  • No. Individuals often come to us because there is financial trouble in their marriage and they are looking to the postnuptial agreement to solve the problem.

How can I reduce the anxiety of my divorce through a logic-based mediation process?

  • Come to mediation with an open mind and consider what areas you are willing and able to compromise on. The mediation process is less stressful because we are able to have an open conversation about what you want and what you need in real time rather than taking and keeping a position. Litigation tends to be win or lose. Mediation tends to be problem solving win-win.
